Filing a WSIB claim.
The WSIB has identified that the best way of reducing the number of claims that are denied, is to improve the way that claims are reported.
If you don’t report your injury, you don’t have protection under the WSIA. Some of the best ways of reporting your injury are:
1) Report all injuries to the employer immediately.
(Especially when you have a loss of income, hours or your job needs modification.)
2) See your family doctor immediately. If you see the same doctor twice, the Board
considers this doctor your doctor of choice. You ‘11 need permission from the
board to change doctors.
3) Don’t call in sick, when you are I.O.D.(Injury on Duty)
4) Keep copies of all forms you submit & doctors notes etc.
5) You must sign the necessary WSIB forms indicating that you are willing to
participate in consent & disclosure, (these are not Manulife forms)
6) If you have a witness, use the same witness when submitting forms, making
statements etc.
7) Keep a journal of who, what, where and when you called them.
Employers must:
1) Report the accident to the board within 72 hours. (Loss of time, modifications etc)
2) Employer must give the worker a copy of their form 7
3) Employer must report accurately dates, times, location of injury, monies (H8)
a) If the employer does not correct the monies earned, location of injury, have the
supervisor who signed the form 7 fix it.
b) If the supervisor -will not fix it, this is considered fraud, and you are encouraged to call
the Board, or their fraud hotline at 1.888.745.3237
The employer is subject to a penalty of $2 50 for LATE REPORTING, INCOMPLETE or inaccurate form 7, failing to provide a form 7
