** Please note the following two MOTIONS to change Local By-Laws:

February 1, 2013

WHEREAS: The membership ratified a new Collective Agreement which took effect on January 1, 2013, and

WHEREAS: a) The accumulation of Sick Leave credits has been eliminated, and b) employees can use any accumulated Sick Leave credits to top up payments from STDP and WSIB, and c) employees are entitled to 7 Personal days each year.

Therefore:

BE IT RESOLVED: that in Article 7.5 of Hamilton Local 548’s By-laws: 7.5 (c) and (d) be deleted; and 7.5 (b) be amended to read:

The Local full-time officers will have the same benefits that are in the Collective Agreement of full-time employees as related to the following:

Statutory holidays, annual leave, all special leave, court leave, personal days, WSIB, STDP, and they will also receive any other benefits negotiated into the Collective Agreement with the exception of overtime, shift premiums, and weekend premiums.

WHEREAS: At the National Convention of October 2011, changes were ratified to Article 8 of The National Constitution by the delegates; and

WHEREAS: Local Disciplinary committees have been eliminated:

Therefore:

BE IT RESOLVED: that Article 13 C) of Hamilton Local 548’s By- laws be deleted, and

Be it further resolved that: Article 13 C) be replaced with: C) Local Conflict Committee

1) This committee shall consist of three (3) members, two elected by the membership, and the third to be appointed by the Executive Committee. Two (2) alternates shall also be elected to serve in the order of their election ( first alternate, second alternate) In the event any elected member(s) of the committee is/are unable or unwilling to serve on a specific charge.

2) Offences and penalties shall be in accordance with Article 8 of the National Constitution.

3) The Local Conflict Committee function shall be to assist members involved in conflict situations, prior to charges being pursued in the disciplinary process.
